Introduction
Welcome to Skoul! These Terms of Use ("Terms") govern your access to and use of the Skoul mobile application ("App"), an educational platform designed specifically for children aged 6-12. By downloading, installing, or using the App, you agree to be bound by these Terms.
IMPORTANT: Skoul is intended for children aged 6-12 years old. If your child is under the applicable age of digital consent (13 in the United States, 15 in France and Spain, or other thresholds in the EU), you as a parent or legal guardian must review and accept these Terms on behalf of your child.

1. Acceptance of Terms
1.1 Agreement to Terms
By using Skoul, you agree to:
- These Terms of Use
- Our Privacy Policy (available at privacy@skoul.fr)
- All applicable laws and regulations governing children's online privacy
1.2 Parental Consent
If your child is:
- Under 13 (United States under COPPA)
- Under 15 (France and Spain under GDPR)
- Under 16 (Other EU countries under GDPR)
- Under 13 (Other countries, as a conservative default)
You, as a parent or legal guardian, must provide consent and supervise your child's use of the App. By completing the onboarding process and checking the consent checkbox, you confirm that:
- You are the parent or legal guardian of the child using the App
- You have read and understood these Terms and our Privacy Policy
- You consent to the collection and use of your child's information as described in our Privacy Policy
- You understand that all data is stored locally on your device
1.3 Age Restrictions
Skoul is designed exclusively for children aged 6-12 years old. Users outside this age range should not use the App. We reserve the right to verify ages and enforce these restrictions.
1.4 Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via the email address you provide (if applicable). Continued use of the App after changes constitutes acceptance of the updated Terms.
2. Description of Service
2.1 Educational Services
Skoul provides interactive educational exercises in three core subjects:
Mathematics:
- Addition, subtraction, multiplication, and division
- Problem-solving exercises
- Currency, time, and distance calculations
- Age-appropriate difficulty levels
Spelling:
- Custom word lists from camera, photo library, or manual entry
- AI-generated spelling exercises
- Practice sessions with immediate feedback
Reading:
- Text-based reading comprehension exercises
- Questions and answers for reading materials
- Progress tracking and performance analytics
2.2 Personalization Features
- User profiles with first name, age, grade level, and country
- Optional avatar customization (stored locally only)
- Difficulty adaptation based on performance
- Progress tracking and session history (stored locally only)
2.3 Exercise Generation
Skoul uses three methods to generate educational content:
1. Primary Method - HIGHTHEM Backend API (France):
- Secure API hosted in France
- Only non-nominative data sent: age, grade, country, difficulty, subject, question count
- Generated exercises returned and stored locally
2. Secondary Method - Google Firebase AI (Gemini, USA):
- Fallback service when backend is unavailable
- Only non-nominative data sent: age, grade, country, language, difficulty, subject, question count

3. Tertiary Method - Apple Intelligence (On-Device):
- Available on supported devices (iPhone 15 Pro, iPad with M1 or later)
- Complete on-device processing with no data transmission
- Text recognition and exercise generation
2.4 Advertisement Services
To support the free availability of Skoul, we display age-appropriate advertisements through Google AdMob:
- No behavioral advertising to children
- Contextual ads only
- You can limit ad tracking in iOS Settings > Privacy > Tracking

2.5 Free Service
Skoul is provided free of charge. We do not collect payment information or offer in-app purchases.
3. User Responsibilities
3.1 Parental Supervision
Parents and guardians are responsible for:
- Supervising their child's use of the App
- Ensuring the device is secure (passcode/biometric lock)
- Monitoring practice sessions and progress
- Teaching appropriate online behavior
- Reviewing and managing data through Settings
3.2 Device and Account Security
You are responsible for:
- Maintaining the security of your iOS device
- Installing iOS updates for security patches
- Preventing unauthorized access to the App
- Keeping your device passcode or biometric authentication secure
3.3 Accurate Information
You must provide accurate and truthful information during onboarding:
- Child's first name
- Age (6-12 years)
- Grade level
- Country
Providing false information may result in inappropriate content delivery or compliance issues.
3.4 Prohibited Uses
You agree NOT to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent security features or restrictions
- Use the App to harm, abuse, or exploit children
- Extract or scrape content from the App
- Upload malicious content or viruses
- Share inappropriate content through the App
- Violate any applicable laws or regulations
- Use the App if you are outside the 6-12 age range
4. Privacy and Data Protection
4.1 Local-First Data Storage
Skoul prioritizes your privacy through local-first architecture:
- All personal data stored locally on your iOS device using SwiftData
- No user accounts or login credentials required
- No cloud synchronization of personal information
- No remote servers storing your child's name, avatar, or practice history
4.2 Data We Collect
During onboarding, we collect:
- First name (stored locally)
- Age between 6-12 (stored locally)
- Grade level (stored locally)
- Country (stored locally)
- Optional avatar photo (stored locally as compressed JPEG)
During practice sessions, we collect locally:
- Session completion records
- Accuracy scores and performance metrics
- Time spent on activities
- Difficulty progression
- Session history
4.3 Data We Send for Exercise Generation
ONLY the following non-nominative data is transmitted to our backend or Firebase AI:
- Age (number only, e.g., "8")
- Grade level (e.g., "Grade 3")
- Country code (ISO code, e.g., "FR")
- Exercise difficulty preference
- Subject (mathematics, spelling, reading)
- Question count
NEVER transmitted:
- Child's name
- Avatar photo
- Practice history or session data
- Device information (except standard HTTP headers)
4.4 Data Encryption
- Local data encrypted at rest using iOS AES-256 encryption
- Data in transit uses TLS 1.3+ encryption
- Certificate pinning for backend API communications
4.5 Data Retention and Deletion
- Local data: Retained until you delete the App or clear data in Settings
- No server retention: We do not store personal data on our servers
- Immediate deletion: Uninstalling the App permanently removes all local data
- No recovery: Deleted data cannot be recovered by HIGHTHEM
4.6 Your Rights (GDPR/COPPA)
You have the right to:
- Access: View all data in Settings > Profile
- Rectification: Edit profile information directly in the App
- Erasure: Delete practice data or all data by uninstalling
- Data Portability: Export data through iOS backup mechanisms
- Object: Disable optional features or limit ad tracking
- Complain: Lodge complaints with CNIL (France) or your data protection authority

5. Intellectual Property Rights
5.1 Ownership
All content, features, and functionality of Skoul are owned by HIGHTHEM and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
This includes but is not limited to:
- App source code and architecture
- User interface design and graphics
- Original illustrations and icons
- Educational content and exercise formats
- Algorithms and business logic
- Branding, logos, and trademarks
5.2 License to Use
Subject to your compliance with these Terms, HIGHTHEM grants you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on iOS devices you own or control
- Use the App for personal, non-commercial educational purposes
- Access features and content within the App
5.3 Restrictions
You may NOT:
- Copy, modify, or create derivative works of the App
- Sell, rent, lease, sublicense, or transfer the App
- Remove copyright, trademark, or proprietary notices
- Use the App or content for commercial purposes
- Redistribute or republish App content
5.4 User-Generated Content
Content created by users (e.g., custom word lists, avatars) remains on the user's device and is not transmitted to HIGHTHEM servers. You retain ownership of such content but grant HIGHTHEM a limited license to process it locally for App functionality.
5.5 Third-Party Content
The App may display content or links from third parties (e.g., AdMob advertisements). We do not claim ownership of third-party content and are not responsible for its accuracy or appropriateness.
6. Third-Party Services
6.1 Google Firebase AI (Gemini)
Skoul uses Firebase AI as a secondary method for exercise generation:
6.2 Google AdMob
Skoul displays advertisements through Google AdMob:
- Subject to Google's privacy policy: https://policies.google.com/privacy
- Collects device identifiers and ad interaction data
- Does NOT receive your child's name, age, or practice data from Skoul
- You can limit ad tracking in iOS Settings > Privacy > Tracking
6.3 Apple Intelligence
On supported devices, Skoul uses Apple Intelligence for on-device processing:
- No data leaves your device
- Subject to Apple's terms and privacy policies
- Available only on iPhone 15 Pro and iPad with M1 or later
6.4 No Other Third Parties
Skoul does NOT use:
- Third-party analytics services (beyond AdMob)
- Social media integrations
- Data brokers or marketing platforms
- Cloud storage providers for personal data
6.5 Third-Party Liability
HIGHTHEM is not responsible for the practices, content, or actions of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
7. Disclaimers and Limitations of Liability
7.1 Educational Purpose
Skoul is designed to supplement, not replace, formal education. The App:
- Provides practice exercises and activities
- Is NOT a substitute for qualified teachers or tutors
- Does not guarantee specific learning outcomes
- Should be used under parental supervision
7.2 "AS IS" and "AS AVAILABLE" Basis
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of content
- Continuous, uninterrupted, or secure access
7.3 No Guarantee of Results
HIGHTHEM does not guarantee:
- Specific educational outcomes or improvements
- Compatibility with all iOS devices
- Error-free or uninterrupted service
- Correction of all defects or bugs
7.4 Limitation of Liability
To the maximum extent permitted by law, HIGHTHEM and its officers, directors, employees, and agents shall NOT be liable for:
Indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or data
- Loss of use or productivity
- Business interruption
- Educational delays or setbacks
Direct damages exceeding the amount paid by you to use the App (which is zero, as the App is free)
7.5 Third-Party Services
HIGHTHEM is not liable for:
- Actions or inactions of third-party services (Firebase AI, AdMob, Apple Intelligence)
- Data practices of third parties
- Content or accuracy of third-party advertisements
- Interruptions in third-party services
7.6 Device and Data Loss
HIGHTHEM is not responsible for:
- Loss of device or theft
- Data loss due to device failure or user error
- Inability to recover data after App deletion
- iOS updates that affect App functionality
7.7 User Actions
HIGHTHEM is not liable for:
- Misuse of the App by users
- Unauthorized access due to user negligence
- Inaccurate information provided by users
- Failure to supervise children's use
7.8 Jurisdictional Variations
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
8. Termination
8.1 Termination by User
You may terminate your use of Skoul at any time by:
- Deleting practice data: Settings > Learning Data > Clear All Practice Data
- Uninstalling the App from your device
Uninstalling the App immediately and permanently deletes all local data. This action cannot be undone.
8.2 Termination by HIGHTHEM
We reserve the right to:
- Suspend or terminate access to the App for violations of these Terms
- Discontinue the App or any features at any time without notice
- Refuse service to anyone for any lawful reason
8.3 Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- You must delete the App and all related content from your devices
- Sections of these Terms that by nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will remain in effect
8.4 No Refunds
As Skoul is free, no refunds are applicable. If we offer paid features in the future, refund policies will be disclosed separately.
9. Compliance with Laws
9.1 COPPA Compliance (United States)
Skoul complies with the Children's Online Privacy Protection Act (COPPA):
- Parental consent obtained for children under 13
- Minimal data collection (only what's necessary)
- No sharing of children's data with third parties for marketing
- No behavioral advertising to children
- Parents can review, delete, or refuse further collection of data
9.2 GDPR Compliance (European Union)
Skoul complies with the General Data Protection Regulation (GDPR):
- Age-gating based on country-specific thresholds (13-16 years)
- Enhanced data subject rights (access, rectification, erasure, portability, objection)
- Lawful basis for processing: parental consent and legitimate interest
- No automated decision-making or profiling
- Right to lodge complaints with supervisory authorities (CNIL in France)
9.3 International Data Transfers
- HIGHTHEM Backend API: Data sent to France (GDPR-compliant)
- Firebase AI: Data sent to United States (Google provides adequate protection under EU-US Data Privacy Framework)
- AdMob: Ad serving may involve transfers to United States

9.4 User Compliance
You agree to comply with all applicable local, national, and international laws and regulations when using the App.
10. Dispute Resolution
10.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
10.2 Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms or the App shall be filed exclusively in the competent courts of France, and you consent to the jurisdiction of such courts.
10.3 Informal Resolution
Before filing a legal claim, you agree to contact us at privacy@skoul.fr to attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes amicably.
10.4 Arbitration (If Applicable)
If informal resolution fails, disputes may be subject to binding arbitration in accordance with French arbitration law, unless prohibited by applicable consumer protection laws.
10.5 Class Action Waiver
To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.
10.6 Exceptions
Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction.
11. Miscellaneous Provisions
11.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HIGHTHEM regarding the use of Skoul and supersede all prior agreements, understandings, or communications.
11.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
11.3 Waiver
The failure of HIGHTHEM to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of HIGHTHEM.
11.4 Assignment
You may not assign, transfer, or delegate these Terms or your rights and obligations without HIGHTHEM's prior written consent. HIGHTHEM may assign these Terms without restriction, including to an affiliate or in connection with a merger, acquisition, or sale of assets.
11.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as expressly stated.
11.6 Force Majeure
HIGHTHEM shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to:
- Acts of God (natural disasters, pandemics)
- War, terrorism, or civil unrest
- Government actions or regulations
- Internet or telecommunications failures
- Third-party service outages (Firebase AI, AdMob, Apple services)
11.7 Notices
Notices to HIGHTHEM should be sent to: privacy@skoul.fr
Notices to you may be provided through the App, via push notification, or by other reasonable means.
11.8 Language
These Terms are provided in English and French. In the event of any conflict between translations, the English version shall prevail.
11.9 Survival
Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimers and Limitations of Liability, Dispute Resolution, and Miscellaneous Provisions.
